Guardianship

Massachusetts Guardianships Attorney in Cambridge

A guardianship involves obtaining the legal authority to make decisions on behalf of a minor, vulnerable adult, or incapacitated individual. Guardians are usually trusted family members such as parents, siblings or spouses. However, state law gives the courts the power to review and make guardian appointments they deem to be in the best interests of the "ward."

At Macero & Associates, P.C., we always put your best interests at the forefront of our representation. We are committed to helping ensure that you have a voice regarding the well-being of your family members. Contact our law office today to discuss your guardianship concerns with our experienced lawyers.

Understanding Guardianships

Where conservatorships address financial responsibility, guardianships focus on responsibility for the day-to-day needs of a loved one, including decisions regarding housing, education and health care. The guardianship process can prove to be very complex and may necessitate the assistance of a qualified attorney who can carefully manage the entire process.

The following at-risk individuals generally benefit from the appointment of a guardian:

  • Minor children - for a specified time period or until 18 years of age, with no termination of parental rights
  • Disabled or physically incapacitated family members - court orders may be required in Massachusetts for those older than 18
  • Elderly family members - when no power of attorney or health care directives exist
  • Mentally ill family members - Alzheimer's disease, dementia, addictions and other conditions

Please note, the court may appoint a guardian ad litem to gather all relevant information before deciding if guardianship is appropriate and who should assume responsibility. This may include taking into account such issues as the significance of the relationship and physical distances.

Attorney Rosemary A. Macero's experience as a guardian ad litem allows her to identify any potential issues, provide practical advice, and make effective recommendations to the court on your behalf.
